ALEXANDRA PARK TICKETING TERMS & CONDITIONS
The Auckland Trotting Club Inc (“ATC”) and its subsidiaries (together “us”, “we” or “our”) operate Alexandra Park. From time to time we host events in the function rooms and at other places at Alexandra Park. Each such event is advertised on this website (Event). In these ticketing terms & conditions, “you” and “your” means the purchaser of tickets to an Event (or the person or organisation on whose behalf you are acting).
By purchasing a ticket to an Event from us you agree to accept and be bound by these ticketing terms & conditions (Ticketing Terms); our Website Terms of Use, our Privacy Policy, and all applicable laws and regulations governing the sale of tickets to you and your attending the Event.
We reserve the right to update these Ticketing Terms without any prior notice. Any update will apply to ticket purchases made after the time of the update.
You should read these Ticketing Terms carefully prior to confirming your order for a ticket to an Event. Any queries relating to these Ticketing Terms should be raised with us prior to the purchase of a ticket, as confirming your order constitutes acceptance of these Ticketing Terms.
We may set additional terms and conditions for a specific Event. Any such additional terms and conditions will be set out on the website page containing the details of the Event or on a website page linked from the Event details.
Purchase Of Tickets
The advertisement of Events and provision of functionality to purchase tickets on this website is not an offer to sell tickets to Events. All tickets must be ordered by you. Tickets may be ordering by you using the functionality provided on this website or by calling our telephone operators on the numbers provided.
All orders of tickets to Events are subject to availability and to acceptance by us.
We may limit the number of tickets available for any Event. We may also limit the number of tickets you may purchase.
To order tickets you must provide us with an email address and other contact details as specified in the ordering process. If you do not provide us with the requested information you will not be able to purchase tickets. It is your responsibility to inform us of any change to the email address or other contact details you provide to enable us to contact you in relation to the tickets you order and/or the Event.
You must be at least 18 years of age to purchase tickets to, and attend, our Events.
The price of tickets to Events will be advertised on this website with the details on the Event. Prices are inclusive of GST.
Payment for any tickets you order must be made at the time you order the tickets. Payment may be made by providing your credit card details to our telephone operators, by a direct payment to our bank account where the booking is made through our telephone operators, or by using the payment mechanism we make available on this website. No other methods of payment will be accepted by us.
We may provide a discount to the advertised price for ordering and paying for tickets using the functionality and payment mechanism we make available on this website. If we do so, the amount of the discount will be specified on this website with the advertised price to the Event.
If your credit card is declined, you do not make the payment to our bank account, or you are otherwise unable to make the necessary payment using the payment mechanism we make available on this website then your order is deemed to be cancelled.
Once payment for the purchase of tickets to an Event has been received by us we will send you a booking confirmation in relation to your purchase. The booking confirmation will be sent to the email address that you provided at the time of your order.
Correction Of Errors
We may change or correct any error relating to an Event on this website, including any errors in any pricing, at any time and all changes will take effect immediately that we make the change.
Your purchase of tickets to an Event is made subject to our right to correct an error, including if that results in a change to the pricing. If the error is material or it relates to pricing and we exercise a right to correct that pricing, we will contact you using the contact details you provide to advise you of the error. In relation to pricing errors, you may elect to pay any additional amount due or alternatively you may cancel your ticket booking and receive a refund of the amount you paid. If the price we charged you was more than the correct price we will contact you to organise a refund of the overpaid amount. If we contact you in relation to any other material error you may elect to proceed, or cancel your ticket and receive a refund of the amount you paid.
If we are unable to contact you in relation to a pricing error where an additional amount is due (or you do not respond to any messages we send you) we may cancel your ticket booking. Where we cancel your booking you are entitled to receive a refund. You will need to contact us to organise a refund in such a case.
Issue Of Tickets
Tickets will not be issued until you arrive at Alexandra Park on the day of the Event. The booking confirmation will tell you the place at Alexandra Park where you are to collect your ticket. To collect your ticket from that place it is preferred by us if you provide your booking confirmation to us as evidence of your booking. However, if you forget your booking confirmation a valid form of identification must be provided to our satisfaction. If you are not able to provide the necessary identification or evidence of your booking we may deny you entry to the Event or remove you from the Event if you have already gained entry.
We will determine the form of the ticket that is to be issued. Such a ticket may be in the form of a wristband. Where a wristband is issued to you it must be worn at all times while you are at the Event venue or otherwise within Alexandra Park. If the ticket is in any other form you must keep it in such manner as we may specify when the ticket is issued. We may remove from Alexandra Park anyone that does not have a valid ticket.
Tickets may only be collected by the person whose contact details are recorded in the booking confirmation. You may not purchase tickets on behalf of another person as the contact person for the booking confirmation unless you provide that person’s name (and any contact details required by the booking process) so they can pick up the ticket. For a group of persons, you must provide such information for each person in the group. All individuals must pick up their tickets individually. If you purchase tickets for any other person you must ensure that they agree to these Ticketing Terms. You warrant that you are able to agree to these Ticketing Terms on behalf of all such other persons and that you have the right to provide their personal information to
Conditions Upon Entry And Standards Of Behaviour
You will not be permitted to enter an Event prior to the designated start time for that Event. While we would prefer you to arrive at the designated start time for an Event, you will still be permitted to enter an Event venue if you arrive after such time. However, if you are late for the Event there is a risk that you may not be able to enjoy the Event in its entirety. If the Event includes food and/or beverages and/or an opportunity to purchase food and/or beverages (food for an Event will ordinarily be served from 6:30pm to 9:00pm), you will not receive any included food and/or beverages or be able to purchase food and/or beverages if you arrive after the time at which it is served or able to be ordered.
We reserve the right to refuse you entry to or eject you from an Event for health and safety reasons or on any other reasonable grounds. We may also refuse entry to or eject you from an Event if we consider that you are acting in an abusive, threating or insulting manner by words or behaviour, wearing inappropriate clothing, creating a nuisance or breaching the peace, undertaking an activity we have forbidden, breaching these Ticketing Terms, or contravening any law. If we think you have had too much alcohol, or are under the influence of drugs, we will ask you to leave Alexandra Park.
We reserve the right to search you and/or possessions upon arrival at the Event to ensure that your entry to the Event does not present a risk to health and safety or breach any of the conditions of entry and standards of behaviour set out in these Ticketing Terms.
The use by you of equipment for recording or transmitting (by digital or other means) any audio or audio-visual material or any information or data inside Alexandra Park is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed (without any liability to us for doing so). The display, distribution, promotion of any unauthorised marketing material is strictly forbidden.
Only alcohol and food purchased from us may be consumed at our Events.
Smoking at the Event is not permitted anywhere in the venue, except in any designated smoking areas.
You must not cause a nuisance to any other attendees of the Event or other persons at Alexandra Park and must at all times comply with all notices and any reasonable requests and instructions of our staff while at the Event or otherwise on the Alexandra Park grounds. The use of any illegal substances or items which may be interpreted as real or potential weapons including sharp or pointed objects is strictly forbidden.
Marketing At The Event
By attending an Event you expressly consent to us photographing, filming and/or making any sound recording, and as the ticket holder you expressly grant us a licence to use any image or recording for marketing or commercial purposes without any need to make payment to you.
If we operate a UAV or drone at Alexandra Park you expressly consent to us doing so, including us using it to take photographs, filming or otherwise making any recording.

Refunds, Exchanges And Transfers
You may cancel your booking and receive a refund of the amount paid if we cancel an Event, make a material change to the Event which means that you no longer want to attend, or to the extent required by law.
You may also cancel your booking and request a refund of the amount paid without reason at any time up to one month prior to the date of the Event.
You may also change a booking for one Event to that of another Event (for which tickets are still available) at any time up to one month prior to the date of the Event you have booked. An additional payment may be required depending on the cost of the Event to which you wish to change your booking. If the cost of the other Event is less than the price you paid for the booked Event the difference will be treated as a request for a refund.
All requests for a refund are at our sole discretion.
To cancel or change a booking or request a refund (or obtain a refund where provided for under these Ticketing Terms) you must contact us or where we make doing so available on this website use the functionality we provide on this website to do so. You will be required to provide any requested information to confirm your identity or as we may require to make a payment to you before we will permit any cancellations or changes or provide any refunds.
Unless we are required to do so by law, we will not provide any other refund in relation to an Event, including where you do not attend, or are late to, the Event.
Variation Of An Event
We reserve the right to cancel, replace, add to, substitute or make any other changes to an Event at any time. We will notify you of any cancellation or any material changes to an Event using the email address or other contact details that you provided to us.
Warranties And Limitation Of Liability
We do not provide any warranties as to the level of enjoyment that you may or may not expect from attending an Event.
Except for personal injury or death caused by negligence and other circumstances where liability may not be limited under any applicable law, our liability and the liability of our officers, employees, agents or sub-contractors in respect of any claim arising as a result of any acts or omissions under or in connection with an Event or these Ticketing Terms, whether caused by breach of contract, misrepresentation, negligence or any other tort, breach of statutory duty or otherwise, will be limited to repayment of the purchase price of your ticket.
We shall not be liable for any loss or damage to personal property or vehicles or their contents belonging to any ticket holder. We do not accept any responsibility for any damage to, or loss of, property left at Alexandra Park prior to, during, or after any Event.
General
If any provision of these Ticketing Terms are held by any court to be illegal, void or unenforceable, such determination shall not impair the enforceability of the remaining provisions.
Our failure to exercise or enforce any right or provision of the Ticketing Terms shall not constitute a waiver of such right or provision.
These Ticketing Terms are governed by the laws of New Zealand. The purchase of tickets to Events is intended only for persons within New Zealand. If you access this website to purchase a ticket from outside New Zealand you agree that the Courts of New Zealand have the exclusive jurisdiction to hear and determine any proceedings brought in relation to these Ticketing Terms and the Event.
